Purpose of this policy

1   To reimburse Developers, who install extended services, a portion of the cost from nearby properties that may use and benefit from these extensions.

Guiding principles

3   (1) Latecomer charges shall be determined and imposed by a resolution of Council where considered applicable by the City according to this policy. Implementation details are contained in Council Procedure P001-05 Latecomer Charges.

(2) Latecomer charges shall be determined only after approved drawings are received and before the signing of a servicing agreement.

(3) Except as provided, all latecomer charges collected by the City shall be paid to the Developer. Developers may assign their rights to receive Latecomer Charges through written instructions to the City.

(4) Latecomer charges shall be collected, with interest, by the City for a period of 15 years from the date of substantial completion of the extended services.

(5) The City shall maintain a record of latecomer charges assessed and collected. Once property owners choose to connect to an extended service, they will be informed of the latecomer charge.

(6) “Permission to Construct”, pursuant to the Development Bylaw, will not be issued for works and services, which are the subject of a latecomer charge, until the servicing agreement covering the extended services has been executed.

(7) “Substantial Completion” shall not be issued by the City until a signed Latecomer Agreement is provided to the City.

(8) Latecomer Charges are not applicable for works and services, or portions of works and services, which are included in the City’s Development Cost Charges program.

(9) No application is required for a Latecomer Agreement. The City will determine if one is warranted.

(10) The Developer shall be charged a Latecomer Administration Fee of $500 plus taxes for each extended service, as outlined in the City of Abbotsford Development Application and Service Fee Bylaw.
