Purpose of this policy

1   To provide guidance to staff and applicants when a development application is made where the current use of land or structure is illegal.

Guiding principles

2   (1) Where an illegal use of land or a structure exists, and Council approval of a development application is requested to make the use of land or structure lawful, the applicant shall be informed that Council normally rejects such requests.

(2) If the applicant insists on making an application, it shall be forwarded to Council for consideration before processing.
