Bylaw 3219-2021
The Council of the City of Abbotsford, in open meeting assembled, enacts as follows:
2 In this bylaw
"eligible application" means an application for a City permit or licence reasonably necessary for the
(a) restoration, repair or rebuilding of an impacted building or structure to a condition not substantially greater than existed immediately before the local state of emergency, or
(b) demolition of an impacted building or structure.
"impacted building or structure" means a building or structure located within a prescribed zone and adversely impacted by the natural disaster giving rise to the local state of emergency;
"local state of emergency" means the local state of emergency declared on November 15, 2021, as extended in accordance with the Emergency Program Act;
"pre-adoption application" means an application that, if it had been submitted before the adoption of this bylaw, would have been entitled to temporary fee relief under section 3;
"prescribed zone" means the highlighted area of
(a) Sumas Prairie depicted in Figure 1 of the Schedule,
3 Despite any City enactment, no fee is payable in respect of an eligible application submitted for City approval in accordance with the enactment before December 24, 2022.
4 Every person who paid a fee in respect of a pre-adoption application is entitled to a refund of the fee upon request to the chief building inspector by December 24, 2022.
