Interpretation

1   The Interpretation Bylaw applies to this bylaw.

Definitions

2   In this bylaw

"eligible application" means an application for a City permit or licence reasonably necessary for the

(a) restoration, repair or rebuilding of an impacted building or structure to a condition not substantially greater than existed immediately before the local state of emergency, or

(b) demolition of an impacted building or structure.

"impacted building or structure" means a building or structure located within a prescribed zone and adversely impacted by the natural disaster giving rise to the local state of emergency;

"local state of emergency" means the local state of emergency declared on November 15, 2021, as extended in accordance with the Emergency Program Act;

"pre-adoption application" means an application that, if it had been submitted before the adoption of this bylaw, would have been entitled to temporary fee relief under section 3;

"prescribed zone" means the highlighted area of

(a) Sumas Prairie depicted in Figure 1 of the Schedule,

(b) Clayburn Village depicted in Figure 2, and

(c) Riverside Street and Grace Avenue depicted in Figure 3.

Temporary fee relief

3   Despite any City enactment, no fee is payable in respect of an eligible application submitted for City approval in accordance with the enactment before December 24, 2022.

Examples of eligible applications for which fees are waived under this bylaw include building permits, demolition permits, development application, soil removal and deposit permits, highway excavation permits, and City utility disconnection and reconnection fees.

Refund

4   Every person who paid a fee in respect of a pre-adoption application is entitled to a refund of the fee upon request to the chief building inspector by December 24, 2022.

Sunset

5   This bylaw expires on December 24, 2022.
