NOW THEREFORE, the Council of the City of Abbotsford, in open meeting assembled, ENACTS AS FOLLOWS:

Citation

1   Bylaw No. 2893-2018 may be cited as "Abbotsford Airport Fee Bylaw, 2018".

Interpretation

2   (a) Schedule "A" contains definitions of terms used in this Bylaw.

(b) Unless otherwise provided in this Bylaw, words and phrases used herein have the same meanings as in the Community Charter, SBC 2003, Local Government Act, RSBC 2015, and Interpretation Act, RSBC 1996, or as the context and circumstances may require.

(c) A reference to a statute refers to a statute of the Province of British Columbia, and a reference to any statute, regulation or bylaw refers to that enactment, as amended or replaced from time to time.

(d) Words in the singular include the plural and gender specific terms include both genders and corporations.

(e) Headings in this Bylaw are for convenience only and must not be construed as defining, or in any way limiting the scope or intent of this Bylaw.

(f) If any part of this Bylaw is held to be invalid by a court of competent jurisdiction, the invalid part is severed and the remainder continues to be valid.

Fee for use

3   (a) Every person using any airport service, facility or space, including land or buildings, shall pay the applicable fees prescribed in Schedule "B" of this Bylaw.

(b) All federal and provincial sales taxes will be added when applicable.

Repeal

4   Bylaw No. 1297-2003, cited as "Abbotsford Airport Fee Bylaw, 2004", and any and all amendments, are hereby repealed.

Schedule "A"

Definitions

In this Bylaw:

"Air Terminal Building" means the Abbotsford Airport located at 30440 Liberator Avenue, Abbotsford, British Columbia.

"Commercial Apron" means the apron area immediately adjacent to the terminal building used for the enplaning and deplaning of passengers.

"Non-Participating Operator" means an aircraft owner or operator providing passenger service that is not a signatory to a current Airport Improvement Fee Agreement with the City of Abbotsford.

"Off-Airport Operator" means a vehicle rental operator licensed by the City that conducts a vehicle rental business at the Airport by shuttling customers with pre-arranged vehicle rental contracts between the Air Terminal Building and facilities located outside the Airport.

"On-Airport Operator" means a vehicle rental operator licensed by the City that conducts a vehicle rental business at the Airport from facilities located within the Air Terminal Building or on lands within the Airport.

"Participating Operator" means an Airline or Airline Operator that uses the terminal processing facilities that has entered into a current Airport Improvement Fee agreement with the City of Abbotsford Airport to collect and remit Airport Improvement Fees to the Airport.

"Training/Test Flight" means a flight operated strictly for the purpose of flight training, instruction or pilot proficiency testing, or flight testing associated with aircraft maintenance, overhaul or servicing, and specifically excludes repositioning and ferry flights.

Applicability

(b) The Aircraft landing fee rates listed in subsection (a), above, must be paid for all domestic, trans border and international landings of piston, turbo-prop and jet powered fixed-wing and rotary aircraft owned or operated by private, commercial, corporate, military or government interests.

(c) Landing fees will not be payable by any current tenant or sub-tenant in good standing of the Abbotsford Airport if the aircraft is domiciled on the leased or licensed area of the tenant or sub-tenant.

(d) Landing fees will not be assessed for any domestic or international landings of piston, turbo-prop and jet powered fixed-wing and rotary aircraft owned or operated by private, commercial, corporate, military or government interests either participating in, or in connection with, a public event sanctioned by the City of Abbotsford to occur on Airport property.

Applicability

(b) The general terminal fee rates listed in subsection (a), above, must be paid in respect of all aircraft operated by Participating Operators and Non-Participating Operators using the Commercial Apron/Air Terminal Building facilities for the loading or unloading of passengers.

(c) The general terminal fee rates are based on maximum passenger seating capacity of aircraft upon arrival at the Abbotsford Airport.

Applicability

(b) The Non-Participating Operator rates are charged for every person that is an outbound passenger of an air carrier departing from the Abbotsford Airport or upon arrival at the Abbotsford Airport; and payable by all carriers who have not entered into an Airport Improvement Fee Agreement with the City of Abbotsford and make use of any of the following: pre-board screening, customs, hold bag screening, baggage carousel or counters.

(c) The Non-Participating Operator rates are only payable once per roundtrip flight regardless of when the return flight takes place.

Applicability

(b) The airport maintenance charge rates listed in subsection (a) above must be paid annually by all airport land tenants, excluding agricultural.

(c) The airport maintenance charge rates are calculated on the basis of the total land area, including buildings occupied under each individual lease or license.

Applicability

(a) The vehicle parking fees listed in Subsection 6 (a), must be paid by every person parking a vehicle in a public parking lot at the Abbotsford Airport, including passengers, meeters and greeters, visitors, tenants, sub-tenants, operators, contractors and sub-contractors.

(b) Despite Subsection 6 (a), a person may park a vehicle displaying

(i) a valid parking permit issued by the Social Planning and Research Council (SPARC), of British Columbia, or

(ii) A Veteran's license plate

for one Two-hour Period at no cost.

(c) Despite Subsection 6 (a), a person authorized by the Airport Manager or delegate may park a vehicle at no cost in a designated Airport Authority parking stall labelled for such use.

Applicability

(b) The fuel concession fees listed in subsection (a), above, must be paid by all airport tenants, sub-tenants and fuel suppliers dispensing fuel on airport lands into aircraft or ground vehicles for purposes of commercial sale, corporate/commercial operation or private use.

Waiver of Fees

8  

(a) To facilitate additional air service development, the Airport General Manager may approve a 100% reduction in landing and terminal fees on new international routes/destinations not currently being operated for a period of

(i) one-year from start of service for all newly scheduled year-round international flights, or

(ii) two-years from start of service for all newly scheduled seasonal international flights.
