The Council of the City of Abbotsford, in open meeting assembled, ENACTS AS FOLLOWS:
1 Bylaw No. 2012-2010 may be cited as "Clearbrook City in the Country Plan Local Area Water Service Establishment Bylaw, 2010".
2 The Clearbrook City in the Country Plan local area service for water main extension installations is established for those properties lying within the boundaries of the local area service, as shown hatched on Drawing No. W-896, attached as Schedule "A".
3 The costs of the local area service shall be recovered according to the cost recovery methods set out in the petition for the local area service, as follows:
(a) 100% of the local area service costs shall be recovered by a local area service tax; and
(b) local area service costs, of up to $939,000.00, shall be recovered by a local area service tax imposed, according to Section 4 of this Bylaw, on the owners of those properties identified in Schedule "B" of this Bylaw lying within the boundaries of the local area service area shown in Schedule "A".
4 (a) An annual parcel tax of $2,233.34 per taxable hectare, including annual interest at 6.1%, is imposed for a period of 20 years on the owners of real property lying within the boundaries of the local area service according to the taxable area established in Schedule "B" for each parcel of real property. The outstanding balance, including accrued interest, can be paid out at any time during the 20 year period.
(b) The taxable area of each parcel of real property shall be determined on the basis of the net developable area which is defined as the gross area of each lot minus areas that are encumbered by:
(i) a registered Statutory Right-of-Way;
(ii) environmental setback areas from watercourses;
(iii) future road dedications fronting existing roads;
(iv) future dedications of the designated alignment of internal roads;
(vi) topographical constraints;
(vii) existing industrial-agricultural developments; and
(viii) land that remains within the Agricultural Land Reserve.
