Schedule "A"

WHEREAS, pursuant to Section 23 of the Police Act (British Columbia), the City has established a municipal police board designated as the "Abbotsford Police Board" (the "Board") to provide policing and law enforcement within the City;

AND WHEREAS E-Comm Emergency Communications for South West British Columbia Incorporated ("E-Comm") is a corporation designated as an emergency communications corporation under Section 2 of the Emergency Communication Corporations Act (British Columbia) ("ECC Act");

AND WHEREAS E-Comm provides emergency communication services to a variety of municipalities, government agencies and emergency services agencies, with such services consisting of emergency communications and related services for public safety and public service, all in the interests of civic improvement and for the benefit of the members of the public;

AND WHEREAS, pursuant to Section 4 of the ECC Act, the Board may, in its own name, become a member of E-Comm for the purpose of having E-Comm provide emergency communication services to the Board, and in connection with such membership may, by bylaw, enter into a member's agreement with the other members of E-Comm;

AND WHEREAS Council desires to enable the Board to arrange for emergency communication services to be provided to the Board by E-Comm, and in connection therewith, for the Board to become a member of E-Comm pursuant to a membership agreement; and

NOW THEREFORE, the Council of the City of Abbotsford, in open meeting assembled, ENACTS AS FOLLOWS:

Citation

1   Bylaw No. 1942-2010 may be cited as "Abbotsford Police Board Emergency Communication Services Enabling Bylaw, 2010".

Members agreement

2   The Board may, for the purpose of becoming a member of E-Comm, enter into an agreement with E-Comm on substantially the terms and conditions set out in the form of agreement attached as Schedule "A" to this bylaw (the "Proposed Agreement"), and in connection therewith, may subscribe for one (1) Class A Share of E-Comm.

Execution of agreement

3   (1) Any duly authorized representative of the Board may, for and on behalf of the Board, execute and deliver the Proposed Agreement and execute and deliver such other documents as may be necessary or desirable in connection therewith; and

(2) the Mayor, or any Acting Mayor, and Corporate Officer, or designate, is hereby authorized to take all such further action or execute all documents on behalf of the City as may be reasonably required in connection with this enabling bylaw.
