WHEREAS the City was advised that the North Parallel Road Bridge over the Sumas Drainage Canal may not be capable of supporting vehicles having heavy loads, except in limited numbers and under certain conditions;
AND WHEREAS the North Parallel Road Bridge is used by numerous dump trucks; AND WHEREAS City staff posted a restriction on the use of the North Parallel Road Bridge pursuant to the Street and Traffic Bylaw, 2006 to prohibit use of the Bridge by dump trucks; AND WHEREAS the above restriction is not observed by operators of dump trucks;
AND WHEREAS Council believes that restrictions on the North Parallel Road Bridge are required on a temporary basis, pending repair or replacement of the Bridge;
AND WHEREAS Council has authority pursuant to the Community Charter and the Motor Vehicle Act to restrict or prohibit some or all types of traffic on a highway on a temporary basis;
The Council of the City of Abbotsford, in open meeting assembled, ENACTS AS FOLLOWS:
2 In this Bylaw:
(a) "North Parallel Road Bridge" means that bridge located along the North Parallel Road at the location shown in Schedule "A" to this bylaw;
(b) "Dump truck" means any vehicle, including a trailer and an off-road or haul truck, that is designed, used, or intended to be used, for the transport, hauling or conveying of aggregate, rock, gravel, crushed rock, dirt, soil or other substance of which land is composed.
3 No person shall drive, operate, push or tow a Dump Truck on the North Parallel Road Bridge, or otherwise travel on or traverse any part of the North Parallel Road Bridge in a Dump Truck.
