Bylaw No. 866-99
WHEREAS the Municipal Act authorizes Council to undertake various works on the initiative of Council, or by petition, as a local improvement;
AND WHEREAS the Council of the City of Abbotsford wishes to undertake road improvements to Essendene Avenue as a local improvement by petition;
AND WHEREAS a petition for the works signed by a majority of owners, representing at least 50% of the value of the parcels which are to be specially charged has been received;
AND WHEREAS a report has been received by Council stating:
(a) the lifetime of the work is 20 years
(b) the estimated cost of the work is $248,800
(c) the share or portion of the total cost which will be specially charged against the parcels benefiting from or abutting on the work is $99,400;
AND WHEREAS Council has established, by by-law, local improvement charges applicable to the class of works to be undertaken by this by-law.
NOW THEREFORE the Council of the City of Abbotsford in open meeting assembled enacts as follows:
1 By law No. 866-99 may be cited as "Local Improvement Construction By-law, 1999 (Essendene Avenue from Pauline Street to West Railway Street)".
2 (a) Council is hereby empowered and authorized to undertake and carry out road improvements on Essendene Avenue, from Pauline Street to West Railway Street, in accordance with general plans on file at the Abbotsford City Hall as a local improvement project and to do all things necessary in connection therewith and without limiting the generality of the foregoing:
(i) to spend the amount of $248,000 for the aforesaid purpose; and
(ii) to acquire all such property, easements, rights-of-way, licences, rights or authorities as may be requisite or desirable for, or in connection with, the construction of the said works.
(b) The total actual frontage of parcels of land abutting on or deemed to abut on the work is 292.59 m, and the total taxable frontage abutting or deemed to abut on the work is 621.25 m.
(c) A frontage tax assessment roll shall be prepared by the Collector for those parcels subject to be specially charged.
(d) The owners’ portion of the cost of the works, including cash commutations, shall be in conformity with Local Improvement Charges By-law No. 473-97.
(e) For the purposes of a Security Issuing By-law under the Municipal Act, this by-law is deemed to be a loan authorization by-law.
