The Council of the City of Abbotsford, in open meeting assembled, ENACTS AS FOLLOWS:

Citation

1   Bylaw No. 472-97 may be cited as "Airport Establishment Bylaw, 1997".

Interpretation

2   Unless the context otherwise requires, the following shall mean:

Airport lands

3   The Bylaw hereby establishes an Airport on those lands presently owned by the City of Abbotsford, located at 1590 Mt. Lehman Road, Abbotsford, and described in Schedule "A" attached hereto and forming part of this Bylaw.

Authorization to construct, use and improve Airport facilities

4   Council may construct buildings, structures and airport facilities including, but not limited to, runways, taxiways, aprons, fuel stations, runway lights, beacons and other navigational aids for use of the Airport by the public.

Regulation of Airport facility and services use

5   All persons entering upon and using Airport facilities and services shall do so pursuant to the rules and regulations that may be established from time to time by Council.

Establishment of a Commission

6   Pursuant to Bylaw No. 470-97, "Abbotsford Airport Authority Bylaw, 1997", a Commission is established to manage and operate the airport for, and on behalf of the City.

Airport Manager's duties and responsibilities

7   Council may appoint a person or persons as Airport Manager who will manage and supervise the day-to-day operations of the Airport in accordance with Council's rules, regulations and policies.

Penalty

8   Any person who violates the provisions of this Bylaw or permits an act or thing to be done in contravention of this Bylaw, commits an offence against this Bylaw, and shall be liable to a fine of not less than One Hundred Dollars ($100.00) and upon summary conviction, to not more than the maximum penalty provided by the "Offence Act" and, where the offence is a continuing one, each day that the offence is continued shall constitute a separate offence.
