WHEREAS the City of Abbotsford is authorized under Section 928 of the Municipal Act, R.S.B.C. 1979, Chapter 290, by by-law, to acquire, hold, use, and improve property for an airport;
AND WHEREAS Section 535 of the Municipal Act authorized the City to grant an option to purchase in favour of the Government of Canada;
AND WHEREAS her Majesty The Queen in Right of Canada ("Canada") wishes to transfer the Abbotsford Airport to the City of Abbotsford;
NOW THEREFORE, The Council of the City of Abbotsford, in open meeting assembled, ENACTS AS FOLLOWS:
Authorization
2 The City is authorized to acquire from the Government of Canada and subsequently hold, use, and improve the Abbotsford Airport, subject to an option granted to the Government of Canada to repurchase the Airport, on the terms and conditions of the following airport transfer documents:
(6) Airport Employee Transfer Proposal;
(7) Memorandum of Agreement on Employment;
(8) Airport Records Agreement;
(9) Assignment, Assumption and Indemnities Agreement; and
and the Mayor and Clerk are authorized to execute and deliver these documents as well as all other statements, instruments, and documents required for this transaction, and Council further authorizes the City Clerk to provide the officer's certificate required under the Agreement to Transfer.
Effective date
3 This by-law shall take effect upon the adoption by the affirmative vote of a majority of Council present at the meeting at which the vote is taken.
