WHEREAS the Council may, by Bylaw, pursuant to the Municipal Act, applicable throughout the City or in any defined area of it, regulate or prohibit, and the regulations may be different for different areas, kennels or other places for the keeping, training, care, breeding, treatment, hospitalization, or boarding of dogs, cats, fur bearing animals, or other animals, whether domesticated or undomesticated; and define areas in which those places are permitted or are not permitted;

AND WHEREAS the Council may further, by Bylaw, define for different species of animals what constitutes a kennel and what is deemed a fur bearing animal;

NOW THEREFORE, the Council of the City of Abbotsford, in open meeting assembled, ENACTS AS FOLLOWS:

Citation

1   Bylaw No. 267-96 may be cited as "Kennel Regulation Bylaw".

Interpretation

2   In this Bylaw, unless the context otherwise requires:

"Animal Beauty Parlour" means a building, structure, or premises in which the business of washing, grooming, clipping, de-fleaing, or ridding an animal of external vermin or clipping of animal nails, is operated or carried on, and which must be licenced to operate as a business under the "Business Licence Bylaw".

"Animal Hospital" means any building, structure, or premises in which animals are cared for, treated, maintained, or hospitalized, and which must be licenced to operate as a business under the "Business Licence Bylaw".

"Dog Kennel" means any building, structure, compound, group of pens or cages, or property in which, or where, four or more dogs are kept for any purpose, and which must be licenced to operate as a business under the "Business Licence Bylaw".

"Hobby Kennel" means a dog kennel in which three or more dogs are kept for the sole purpose of breeding and which is operated under a name registered with the "Canadian Kennel Club".

Animal Hospital and Dog Kennel requirements

3   Every building, or part thereof, used as an Animal Hospital or Dog Kennel shall comply with the following requirements:

(1) shall not be constructed prior to approval by the Poundkeeper and the granting of a building permit by the Building Inspection Department;

(2) shall have a ceiling height of not less than seven feet;

(3) shall have walls and floors constructed of impervious material, and all open air runs shall have concrete floors sloped to a floor drain;

(4) shall be well lighted by windows or skylights; windows shall be not less than 1.5 m above the floor;

(5) shall be provided with adequate ventilation;

(6) shall be kept in good repair at all times;

(7) shall have all walls and partitions separating pens of impervious material solid for a height of 1.5 m above the floor, and runs shall be enclosed by a solid wall of 0.9 m above the ground; the remaining 0.6 m in height may be constructed with wire mesh;

(8) shall be provided with an adequate supply of water for drinking, washing, and cleaning purposes;

(9) shall contain a whelping area properly separated from the kennel or boarding area by permanent partitions;

(10) shall have an isolation pen for any animal suffering from any contagious disease; and

(11) each kennel shall be kept clean, and excrement and waste shall be disposed of in a manner which does not cause a nuisance.

Additional Animal Hospital requirements

4   Every building, or part thereof, used as an animal hospital shall comply with the following requirements, namely each such building:

(1) shall comply with Abbotsford Zoning Bylaw, 1996, as amended or replaced from time to time;

(2) shall have a floor area of not less than 0.9 m2 for each animal kept therein;

(3) shall have all pens and cages of a design, finish, and size so as not to restrict the animals unnecessarily and to permit ready cleansing;

(4) shall have an adult person in attendance at all times;

(5) shall be supervised by a properly registered Veterinary Surgeon; and

(6) all animal hospitals shall be operated in such a manner as not to create a nuisance to anyone occupying property in the vicinity and shall be subject to the provisions of the "Noise Regulation Bylaw" of the City of Abbotsford.

Additional Dog Kennel requirements

5   (1) Dog kennels shall comply with Abbotsford Zoning Bylaw, 1996, as amended or replaced from time to time.

(2) Every building, or part thereof, used as a dog kennel shall contain a pen of 1.5 m2 within the building and an open run containing at least 5.5 m2 for each dog.

(3) The outside perimeter fence of runs shall be screened by a hedge or other suitable form of landscaping to a height of at least 1.5 m so as to totally obstruct the vision of a person standing 6.0 m away.

(4) Siting of dog kennels shall be as follows:

(a) 30 m from exterior lot lines;

(b) 15 m from interior lot lines;

(c) 30 m from all wells, and 15 m from all streams; and

(d) 15 m from all buildings for residential uses.

(5) All dog kennels shall be operated in such a manner as not to create a nuisance to anyone occupying property in the vicinity, and shall be subject to the provisions of the "Noise Regulation Bylaw" of the City of Abbotsford.

Animal Beauty Parlour requirements

6   Every building, or part thereof, used as an animal beauty parlour shall comply with the following requirements, namely, that each such building:

(1) shall comply with Abbotsford Zoning Bylaw, 1996, as amended or replaced from time to time;

(2) shall be well lighted and be provided with adequate ventilation;

(3) shall have an adult person in attendance at all times;

(4) every animal beauty parlour shall be restricted to the following services, namely: washing, grooming, de-fleaing, clipping of nails, or ridding an animal of external vermin;

(5) no animal shall be kept, boarded, or quartered overnight in an animal beauty parlour;

(6) all animal beauty parlours shall be operated in such a manner as not to create a nuisance to anyone occupying property in the vicinity, and shall be subject to the provisions of the "Noise Regulation Bylaw" of the City of Abbotsford.

Hobby Kennel

7   Every building, or part thereof, used as a Hobby Kennel, shall comply with the following requirements:

(1) shall comply with Abbotsford Zoning Bylaw, 1996, as amended or replaced from time to time;

(2) provide sufficient space therein for the dog or dogs to stand and lie in comfort, and be kept in a sanitary, well-ventilated, clean condition, free of offensive odours;

(3) contain facilities whereby each dog has adequate access to drinking water;

(4) be kept at a reasonable temperature;

(5) be constructed to ensure that each dog shall have space for adequate exercise either within the kennel or adjacent thereto;

(6) shall be kept clean of excrement and food waste;

(7) not more than 10 dogs over the age of six months shall be kept in a Hobby Kennel at any one time;

(8) there shall be no boarding, grooming, or training of dogs not owned by the kennel owner;

(9) Sections 3 (1),  3 (3), and  5 (3) of this Bylaw shall apply to Hobby Kennels;

(10) siting of Hobby Kennels shall be as follows:

(a) 30 m from exterior lot lines;

(b) 15 m from interior lot lines; and

(c) 30 m from all wells, and 15 m from all streams.

(11) all Hobby Kennels shall be operated in such a manner as not to create a nuisance to anyone occupying property in the vicinity, and shall be subject to the provisions of the "Noise Regulation Bylaw" of the City of Abbotsford.

Licences

8   The owner of a dog kennel or a hobby kennel is required to pay an annual licence fee under the provisions of the "Dog Licence Bylaw".

Inspection of premises

9   The Poundkeeper of the City of Abbotsford, Bylaw Enforcement Officer, or any Peace Officer, is hereby authorized and empowered to enter at all reasonable times upon any property to ascertain and ensure that the provisions of this Bylaw are being complied with.

Offence and penalties

10   [Repealed, B/L 3063-2020.]

Repeals bylaw

11   District of Matsqui Bylaw No. 1280, cited as "Kennel Regulation Bylaw", and all amendments thereto, are hereby repealed.
